AN ORDINANCE OF THE CITY OF POCATELLO, A MUNICIPAL CORPORATION OF IDAHO, AMENDING ORDINANCE NO. 2819, THE APPROPRIATION ORDINANCE FOR THE FISCAL PERIOD OCTOBER 1, 2007, THROUGH SEPTEMBER 30, 2008, AND AMENDING ORDINANCE NO. 2840, A PREVIOUS AMENDMENT OF THE ORIGINAL APPROPRIATION ORDINANCE: PROVIDING FOR AN INCREASE IN EXPENDITURES IN THE GENERAL FUND, STREET FUND, RECREATION FUND, LIBRARY FUND, WATER FUND, UTILITY BILLING FUND, MEDICAL INSURANCE FUND, WATER DEBT SERVICE FUND, STREET SPECIAL PROJECTS FUND AND RETIREMENT PAYOUT FUND; WHICH INCREASES THE TOTAL FISCAL YEAR EXPENDITURES BY 81,578,497.00 PROVIDING THAT THE REVENUE TO PAY FOR SAID INCREASES SHALL BE DERIVED FROM TRANSFERS, GRANTS, SERVICE FEES, REIMBURSEMENTS AND WATER BOND PROCEEDS: PROVIDING THAT ALL OTHER PORTIONS OF APPROPRIATION ORDINANCE NO. 2819 AND AMENDMENT ORDINANCE NO. 2840 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT: PROVIDING THAT THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND PUBLICATION ACCORDING TO LAW, THE RULE REQUIRING THAT AN ORDINANCE BE READ ON THREE SEPARATE OCCASIONS HAVING BEEN DISPENSED WITH.

WHEREAS, after the Fiscal Year 2008 Appropriations Ordinance was passed and approved, additional revenues, including grant funds, have been received which will require additional appropriations; and

WHEREAS, an amendment to the FY 2008 appropriations ordinance was previously approved; and

WHEREAS, a further amendment to the FY 2008 appropriation ordinance is required to reflect the increased revenue and expenditures for the above-mentioned purposes; and

WHEREAS, notice and hearing have been provided in accordance with Idaho Code 50-1002, 50-1003, and 50-1006; and

WHEREAS, the City Council has determined the approval of this further amendment to the FY 2008 appropriation ordinance to be fiscally sound and in the best interests of the citizens of the City of Pocatello:

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF POCATELLO AS FOLLOWS:

Section 1: That the appropriations and the amount appropriated for the General Fund, Street Fund, Recreation Fund, library Fund, Water Fund, Utility Billing Fund, Medical Insurance Fund, Water Debt Service Fund, Street Special Projects Fund and Retirement Payout Fund and the resultant expenditures as set out in Section 1 of Ordinance No. 2819 and Section 1 of Ordinance No. 2840, be hereby amended to reflect increased expenditures to be derived from additional revenues and/or grant funds:

Section 3: That this Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law, the rule requiring that an ordinance be read on three separate occasions having been dispensed with.

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2008, APPROPRIATING THE SUM OF $232,000.00 TO DEFRAY THE EXPENSES AND LIABILITIES OF THE CITY OF BLOOMINGTON FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF A SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATIONS IS MADE.

NOTICE IS HEREBY GIVEN, in accordance with Idaho Code 63 - 1311A, by the City of Georgetown, Idaho, that the Georgetown City Council will meet at 7:00 pm on October 7, 2008, at the Georgetown City Hall, 382 Main St., Georgetown, Idaho to consider public comment regarding the increase in the monthly water and sewer utility rates. Said increase is to help defray maintenance costs to the water and sewer utilities and to help match funds for the sewer feasibility study grant being done by Keller Engineering. Information about the proposed rates may be obtained from the office of the City Clerk at Georgetown City Hall during regular business hours.

NOTICE IS HEREBY GIVEN that the City of McCammon, Bannock County, Idaho (the “City”), has petitioned, pursuant to Idaho Code ยง 7-1301, et. seq. for judicial confirmation of the validity of a certain proposed loan obligation and related matters to be incurred by the City.

The Petition seeks confirmation of the validity of the power and authority of the City of McCammon, Idaho, to: (a) incur an indebtedness in a principal amount not to exceed $1,600,000 for the financing of the cost of certain improvements to the City’s existing wastewater/sewer collection and treatment system and the City’s existing water supply system as an “ordinary and necessary expense” within the meaning of Article, 8, Section 3, Idaho Constitution; (b) enter into certain loan agreements with the State of Idaho, Department of Environmental Quality and to issue its promissory notes or other evidence of such indebtedness; and (c) pledge to repay the obligations of the City from the wastewater/sewer system revenues and water system revenues, respectively, and other lawfully available funds of the City.

The Petition further seeks a declaration that such evidence of indebtedness, when issued pursuant to such authority, will be a valid and binding obligation of the City of McCammon, payable in accordance with its terms.

Interested parties who wish to review the Petition, or any of the documents referred to or incorporated in the Petition, may do so during normal business hours at the office of the City Clerk, McCammon City Hall, 802 Front Street, McCammon, Idaho 83250.

Notice of Public Hearing, Bannock County Juvenile Courtroom

BANNOCK COUNTY, IDAHO
NOTICE OF PUBLIC HEARING

Notice is hereby given that the Board of County Commissioners of Bannock County, Idaho (the “County”) will hold a hearing on September 30, 2008, at the hour of 10:00 a.m., at the Chambers of the County Commission at the Bannock County Courthouse, 624 E. Center, Pocatello, Idaho to determine whether to proceed with financing of an expansion of the juvenile courtroom located at 137 South 5th Ave., Pocatello, Bannock County, Idaho which addition is estimated to cost up to approximately Three Hundred Fifty Thousand Dollars ($350,000) (the “Project”), whether to enter a Municipal Lease Purchase Agreement (the “Agreement”) in order to finance the Project and whether to file a petition pursuant to the Idaho Judicial Confirmation Law, Idaho Code, Section 7-1301 et seq., describing the Project and the Agreement and requesting a judicial confirmation of the power and the authority of the County under the constitution and laws of Idaho to approve entering into the Agreement and related documents in order to provide for the acquisition and construction of said Project. It is not expected that the Agreement will require an increase of County taxes.
