City of Lava Hot Springs Ordinance 2008-5

ORDINANCE NO. 2008-5

AN ORDINANCE OF THE CITY OF LAVA HOT SPRINGS, IDAHO, REPEALING SECTION 10-2-5A, AND SUBSTITUTING A NEW SECTION THEREFOR ESTABLISHING SEWER CONNECTION FEES; AMENDING SECTION 10-2-5C TO DELETE REFERENCE TO ADDITIONAL FEES CONTAINED THEREIN; AND ADDING A NEW SECTION TO CHAPTER 2, TITLE 10, OF THE CITY CODE OF LAVA HOT SPRINGS, IDAHO, TO PERMIT THE CITY COUNCIL TO ESTABLISH AN EQUIVALENT USER SCHEDULE, AND TO SET SEWER CONNECTION FEES AS WELL AS OTHER FEES FOR USAGE OF THE SANITARY SEWER SYSTEM OF THE CITY BY RESOLUTION OF THE CITY COUNCIL; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE; WAIVING THE RULE THAT THIS ORDINANCE BE READ ON THREE SEPARATE OCCASIONS; AND ESTABLISHING AN EFFECTIVE DATE OF THIS ORDINANCE;

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF LAVA HOT SPRINGS, IDAHO, AS FOLLOWS:

Section 1: Section 10-2-5 A is hereby repealed and the following section is substituted therefor:

Section 10-2-5. Sewer Connection Fees

A. Fee Established: The sewer connection fee for a user inside the City shall be as follows:

8 inch $2,000.00

Section 2: Section 10-2-5 C, City Code of Lava Hot Springs, Idaho, is hereby amended as follows:

C: Cost of Connection; Additional Fees: The foregoing fees are for the privilege of connecting with the city sewer, and all work necessary for making proper connection shall be done to the satisfaction of and under the supervision of the city inspector and shall be paid for by the person desiring such connection; and further such person shall pay a permit fee of five dollars ($5.00) and inspection fee of five dollars ($5.00).

Section 3: The connection fees referred to in Section 1 above shall be effective as of October 1, 2008. The City Council is hereby authorized to set an equivalent user schedule for users of the sanitary sewer system of the City, and to establish connection fees as well as other fees for users of said sanitary sewer system by resolution of the City Council.

Section 4: All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed.

Section 5: The rule requiring that this Ordinance be read on three separate occasions is hereby waived.

Section 6: This Ordinance shall be in full force and effect from and after its passage, approval, and publication according to law.

City of Lava Hot Springs Ordinance 2008-3 Appropriations for FY2009

ORDINANCE NO. 2008-3

AN ORDINANCE ENTITLED THE ANNUAL APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2008, APPROPRIATING THE SUM OF $2,254,099.00 TO DEFRAY THE EXPENSE AND LIABILITIES OF THE CITY OF LAVA HOT SPRINGS FOR SAID FISCAL YEAR, AUTHORIZING A LEVY OF A SUFFICIENT TAX UPON THE TAXABLE PROPERTY AND SPECIFYING THE OBJECTS AND PURPOSES FOR WHICH SAID APPROPRIATION IS MADE.

BE IT ORDAINED by the Mayor and City Council of the City of Lava Hot Springs, Bannock County, Idaho.

SECTION 1: That the sum of $2,254,099.00 and the same is appropriated to defray the necessary expenses and liabilities of the City of Lava Hot Springs, Bannock County, Idaho for the fiscal year beginning October 1, 2008.

SECTION 2: The object and purposes for which such appropriation is made, and the amount of each object and purpose is as follows:

SECTION 5: This ordinance shall take effect and be in full force upon its passage, approval and publication in one issue of the Idaho State Journal, a newspaper of general circulation in the City of lava Hot Springs, and the official newspaper of said City,

Public Hearing, City of Lava Hot Springs

NOTICE OF PUBLIC HEARING ON INCREASED FEES

The City of Lava Hot Springs proposes to increase the monthly sewer equivalent user rate, sewer connection fee and metered water rate beginning October 1, 2008, by amounts that exceed one hundred and five percent (105%) of the respective fees from the current fiscal year.

The fee increase will be $3.75 per sewer equivalent user. This will increase the monthly equivalent sewer rate from $12.00 to $15.75. The fee increase will be $850 for a sewer connection. This will increase the sewer connection fee from $150 to $1,000. The fee increase will be $ .10 per thousand gallons for metered water usage. This will increase the monthly metered water usage rate from $ .50 per thousand gallons to $ .60 per thousand gallons.

The fee increases are due to additional costs necessary for maintenance and operation, mandated sewer improvements/capital outlays and asphalt restoration disturbed when sewer connections are made.

All citizens are invited to attend a public hearing on the proposed fee increases on Tuesday, September 9, 2008 at 5:30 p.m., Lava City Hall, 115 West Elm Street, Lava Hot Springs, Idaho.

Lava City Hall is accessible to persons with disabilities. Special accommodations are alternative formats for non-English speaking persons are persons with disabilities will be available upon request with a minimum of 5 days notice prior to the hearing.
